TERMS OF SERVICE

These Terms of Service (the “Terms”) govern access to and use of athleticpotentialpt.com (the “Site”). The Site is operated for Athletic Potential Performance Physical Therapy LLC in Washington and Athletic Potential LLC in Florida. Together, these entities are referred to as “Athletic Potential,” “we,” “us,” or “our.”

By accessing or using the Site, you agree to these Terms and our Acceptable Use Policy. If you do not agree, do not use the Site.

SCOPE OF THESE TERMS

These Terms govern the public Site only. Clinical care, performance services, scheduling, payment, cancellation, and other service matters may be subject to separate agreements, notices, consents, and policies provided during the applicable intake or enrollment process. If a separate written agreement conflicts with these Terms regarding a service, the separate agreement controls that service.

INFORMATIONAL CONTENT AND MEDICAL DISCLAIMER

Site content is provided for general informational and educational purposes. It is not medical advice, diagnosis, treatment, or a substitute for an evaluation by a qualified healthcare professional. Use of the Site, including submission of a callback request, does not by itself create a provider-patient relationship.

The Site is not monitored for emergencies. If you believe you are experiencing a medical emergency, call 911 or seek appropriate emergency care.

CALLBACKS, SCHEDULING, AND SERVICE AVAILABILITY

A callback request is a request for contact only. It is not an appointment, acceptance as a patient or client, guarantee of availability, or confirmation that a particular service is appropriate. Do not include medical details in the public form or in ordinary email.

Services described on the Site may vary by location, provider availability, professional licensure, clinical appropriateness, and applicable law. Remote clinical services are available only where the treating professional is authorized to provide them. Third-party scheduling platforms are governed by their own terms and policies.

FEES, INSURANCE, AND REIMBURSEMENT

Athletic Potential operates on a cash-pay and out-of-network basis unless stated otherwise in a separate written agreement. Any discussion of possible insurance reimbursement is general information, not a promise of coverage or payment. Some services described on the Site may be nonclinical and may not be eligible for insurance reimbursement. You are responsible for confirming benefits and coverage with your insurer.

OWNERSHIP AND LIMITED LICENSE

The Site and its text, graphics, photographs, video, logos, designs, and other content are owned by Athletic Potential or used with permission and are protected by applicable intellectual-property laws. Subject to these Terms, Athletic Potential grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for personal, noncommercial purposes. No other right or license is granted.

PROHIBITED CONDUCT

You may not misuse the Site, interfere with its operation or security, gain unauthorized access to any system, submit unlawful or harmful content, or use Site content in violation of another person's rights. Additional restrictions appear in our Acceptable Use Policy.

THIRD-PARTY SERVICES AND LINKS

The Site may link to scheduling, mapping, video, social-media, or other third-party services. Links are provided for convenience and do not place those services under Athletic Potential's control. Your use of a third-party service is governed by that party's terms and privacy practices.

DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Site is provided “as is” and “as available.” Athletic Potential disclaims warranties concerning the Site, whether express, implied, or statutory, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, and noninfringement. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Athletic Potential and its members, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to use of, inability to use, or reliance on the Site. This limitation does not apply to liability that cannot lawfully be limited or excluded. These Terms do not alter any rights or obligations arising under a separate agreement for clinical care or other services.

GOVERNING LAW

These Terms and use of the Site are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except to the extent the law of another jurisdiction must apply. Separate service agreements may contain different governing law or dispute provisions.

CHANGES, SEVERABILITY, AND WAIVER

We may revise these Terms to reflect changes in the Site, our practices, or applicable law. Revised Terms will be posted on this page with a new effective date. Your use of the Site after the revised Terms take effect constitutes acceptance of the revised Terms.

If a provision of these Terms is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
