CONSUMER HEALTH DATA PRIVACY POLICY
Effective Date: September 3, 2026
This Consumer Health Data Privacy Policy applies to consumer health data collected through athleticpotentialpt.com (the “Site”) to the extent the Washington My Health My Data Act applies. It is separate from our general Privacy Policy.
The Site is operated for Athletic Potential Performance Physical Therapy LLC in Washington and Athletic Potential LLC in Florida. The Site is designed as a public information and callback-request service. It is not a patient portal and does not ask for medical details.
CATEGORIES OF CONSUMER HEALTH DATA COLLECTED AND PURPOSES
- Callback-request data. A name, who the request is for, broad sport or activity context, baseball or softball role when applicable, preferred location, state for remote services, broad service interest, applicable delivery or treatment preference, requested consultation topic, desired start timeframe, callback method and time, email address or telephone number, and acknowledgment of the payment-model notice. A request or preference may identify a person as seeking a health-related service. We use this data to route and respond to the requested callback, document presentation of the payment notice, and protect the form against misuse.
- Health-related page-request data. A requested page address may refer to a condition, injury, procedure, or service. The technical request may also include an IP address, browser or user-agent information, date and time, referrer, and security or error records. We use this data to deliver and secure the Site, prevent abuse, diagnose technical failures, and understand aggregate Site use. Vercel Web Analytics receives the page address after query strings and fragments are removed, along with the event time, referrer, general device and browser type, and approximate region. Analytics events do not include a name, email address, telephone number, form contents, or clinical information.
- Arizona opening-interest data. An email address, consent record, subscription status, and unsubscribe or suppression status for a person who separately requests Arizona opening emails. We use this data to send the requested updates and administer the subscription.
Do not submit information about an injury, diagnosis, surgery, symptoms, imaging, medication, treatment, or other clinical matters through the public form or by ordinary email.

- Your browser, device, and network when you request a page or submit a form.
CATEGORIES OF CONSUMER HEALTH DATA SHARED
Callback-request data may be shared with the Athletic Potential affiliate responsible for the location or service you requested. The shared data consists of the callback fields described above. This limited routing is used to provide the callback you requested.
We do not otherwise share consumer health data with third parties or affiliates as “sharing” is defined by the Washington My Health My Data Act. We do not sell consumer health data.
THIRD PARTIES AND SPECIFIC AFFILIATES
We do not share consumer health data with third parties as that term is defined by the Washington My Health My Data Act.
The specific affiliates that may receive callback-request data based on the location or service requested are:
- Athletic Potential Performance Physical Therapy LLC, Washington.
- Athletic Potential LLC, Florida.
Vercel processes limited page-request and aggregate analytics information on our behalf to host, secure, and measure the Site. We treat Vercel as a service provider and processor rather than as a recipient with an independent right to use consumer health data.
YOUR WASHINGTON RIGHTS
Subject to applicable law, you may:
- Confirm whether we collect, share, or sell consumer health data concerning you and access that data.
- Obtain a list of third parties and affiliates with whom your consumer health data was shared or sold, including their contact information.
- Withdraw consent from future collection or sharing.
- Request deletion of consumer health data concerning you.
- Appeal a refusal to act on a request.
We will not unlawfully discriminate against you for exercising these rights. Responses are provided without charge up to twice annually unless the law permits a reasonable fee or refusal for a manifestly unfounded, excessive, or repetitive request.
SUBMITTING A REQUEST
Email dylan.newcomer@athleticpotentialpt.com with the subject “Consumer Health Data Request.” Include your name, contact email, and the right you wish to exercise. Do not include medical details.
We may request information reasonably necessary to authenticate your identity and authority. You are not required to create a new account to submit a request.
We will respond without undue delay and within 45 days after receipt. We may extend the response period once by an additional 45 days when reasonably necessary and will notify you of the extension and reason within the initial response period. Deletion from archived or backup systems may be delayed as permitted by law. We will also direct applicable processors, contractors, and other recipients to honor a valid deletion request as required by law.
APPEALS
To appeal a refusal, email the address above with the subject “Consumer Health Data Appeal.” We will respond in writing within 45 days. If an appeal is denied, our response will identify a method for contacting the Washington State Attorney General.
CHANGES TO THIS POLICY
Before collecting, using, or sharing a category of consumer health data or using consumer health data for a purpose not disclosed in this Policy, we will update this Policy and obtain affirmative consent when required by law.
