CONSUMER HEALTH DATA PRIVACY POLICY

CONSUMER HEALTH DATA WE COLLECT AND WHY

• Service-interest and lead data. A requested clinic, provider, broad service, appointment type, or consultation may identify a person as seeking health care. We may receive this information with a name, email address, telephone number, contact preference, and the choices shown on a Site or advertising lead form. We use it to respond, route the request, discuss fit, and provide the follow-up the person requested.
• Scheduling data. The Site processes the selected clinic, appointment type, date and time, email address, telephone number, and phone-country selection to display availability and submit an appointment request to PtEverywhere. Account registration and clinical intake occur through PtEverywhere.
• Care and cost estimate data. A planning estimate may include a clinic, provider, service category, visit frequency, estimated duration, treatment preferences, expected cost, payment preference, and selected Cherry payment example. We use it to create the requested estimate, carry it into scheduling, email it when requested, and discuss it with the selected clinician.
• Health-related page-request data. A requested page may refer to a condition, procedure, injury, or service. Hosting and security systems process the page address with ordinary request data such as an IP address, browser or user-agent information, date and time, referrer, and security or error records. We use it to deliver and secure the Site, prevent abuse, and diagnose failures. When Vercel Web Analytics is enabled, it may also process a page address without query strings or fragments, event time, referrer, general device and browser type, and approximate region for aggregate measurement.
• Financing-tool activity. The Cherry widget creates anonymous browser identifiers and records basic widget and device events. If a person chooses to pursue financing, Cherry collects the application information directly under its own privacy policy. We use Cherry payment examples only to discuss a possible payment approach and do not treat an example as an approval or financing agreement.
• Arizona opening interest. An email address and subscription record may identify someone interested in a future health-care location. We use it to send the updates that person requested and manage the subscription.

Please do not place diagnoses, symptoms, surgery details, medical records, imaging, medication, or other clinical information in a public Site form, advertising lead form, or ordinary email.

• You, when you build an estimate, book, submit a lead form, or request updates.
• Your browser, device, and network when you request a page or use a Site tool.
• Meta or another advertising platform when you choose to submit an Athletic Potential lead form on that platform.
• PtEverywhere when it processes an availability or booking request.

CONSUMER HEALTH DATA WE SHARE

We may route the categories listed above to the Athletic Potential business or provider responsible for the clinic or service requested. We may disclose the minimum needed data to processors that run the Site, booking, email, estimate, waitlist, security, or financing tools described below.

We do not sell consumer health data. We do not use Meta Pixel, Meta Conversions API, or another Site tool to disclose consumer health data to Meta for advertising. If you submit a lead form inside Facebook or Instagram, Meta collects that information on its own platform and sends a copy to us as the source of the lead.

AFFILIATES AND PROCESSORS

Specific affiliates that may receive a request are:

• Athletic Potential Performance Physical Therapy LLC, Washington.
• Athletic Potential LLC, Florida.

Processors may handle limited information on our behalf to provide a requested service or run the Site. They include:

• Vercel for hosting, security, technical operations, and Web Analytics when enabled.
• PtEverywhere for account registration, availability, and appointment booking.
• Upstash or Vercel KV for short-lived, hashed booking safeguards.
• Resend and Google Workspace for permitted estimate and contact emails.
• Kit for separately requested Arizona updates.
• Cherry and its service providers, including Segment, for embedded financing tools and any financing process a person chooses to begin.

Under the Washington law, a processor acting only on our instructions is treated differently from a third party that receives data for its own purposes. Cherry also applies its own privacy policy when a person opens or uses Cherry's financing service.

YOUR WASHINGTON RIGHTS

Subject to applicable law, you may:

• Confirm whether we collect, share, or sell consumer health data concerning you and access that data.
• Obtain a list of third parties and affiliates with whom your consumer health data was shared or sold, including their contact information.
• Withdraw consent from future collection or sharing.
• Request deletion of consumer health data concerning you.
• Appeal a refusal to act on a request.

We will not unlawfully discriminate against you for exercising these rights. Responses are provided without charge up to twice annually unless the law permits a reasonable fee or refusal for a manifestly unfounded, excessive, or repetitive request.

SUBMIT A REQUEST

Email dylan.newcomer@athleticpotentialpt.com with the subject “Consumer Health Data Request.” Include your name, contact email, and the right you want to exercise. Please leave medical details out of the request.

We may ask for information reasonably needed to authenticate your identity and authority. You do not need to create a new account to submit a request.

We will respond without undue delay and within 45 days after receipt. We may extend that period once by 45 days when reasonably necessary and will explain the extension during the first response period. Deletion from archived or backup systems may take longer when the law permits. We will also direct applicable processors, contractors, and recipients to honor a valid deletion request when required.

APPEALS

To appeal a refusal, email the address above with the subject “Consumer Health Data Appeal.” We will respond in writing within 45 days. If we deny the appeal, our response will identify a way to contact the Washington State Attorney General.

CHANGES TO THIS POLICY

Before we collect, use, or share another category of consumer health data or use it for another purpose not disclosed here, we will update this Policy and obtain affirmative consent when required by law.
